Terms of sale and website use

1. Seller and contact details
The website https://thatsitbeauty.com and its related services are operated by THAT'S IT BY FABRIZIO ROSA SRL, trading as “That's It by Fabrizio Rosa”, VAT number IT04122710124, registered with the Varese Business Register, REA VA-403545, with registered office at Via Alessandro Volta 1, 21052 Busto Arsizio (VA), Italy. 2. Scope
These terms govern use of the website and purchases made online. A “consumer” is a natural person acting for purposes outside their trade, business or profession. Mandatory consumer-protection rules prevail over any incompatible term. Business purchases are governed by the relevant rules and agreements.
3. Products, prices and availability
We show the essential product characteristics, total price and applicable taxes before an order is placed. Images may vary slightly because of screen settings or packaging changes without altering the stated essential characteristics. We may correct an obvious error before accepting an order; if you do not confirm the purchase on the corrected terms, we will inform you and refund without delay any amount already collected.
Availability is updated with reasonable care but cannot be guaranteed until confirmation. If a product becomes unavailable after payment, we will notify you and refund the relevant amount.
4. Orders, contract formation and payment
Before submitting an order, you can review and correct its details. Submitting an order constitutes an offer to purchase; the contract is concluded when you receive our acceptance or dispatch confirmation, unless a mandatory statement at checkout provides otherwise. We may refuse an order because of unavailability, a well-founded suspicion of fraud, an obvious error or a legal obligation, and will communicate the outcome and refund any amount due.
Available payment methods, any charges and the final total are shown in the Shopify-managed checkout. We do not store full payment-card details.
5. Shipping
Shipping zones, rates, free-shipping thresholds and indicative times are set out in the Shipping Policy. The final total is shown before payment. Delivery times are estimates and do not reduce statutory rights in the event of non-delivery or late delivery.
6. Withdrawal, returns and refunds
Consumers may exercise the right of withdrawal within the time limits and subject to the exceptions provided by law. The full procedure—including the online “Withdraw from the contract here” function, return costs, the 14-day period, the health or hygiene exception for goods delivered with a genuine protective seal only once that seal has been opened after delivery, and refund timing—is set out in the Return and Refund Policy.
7. Statutory guarantee
Products sold to consumers are covered by the statutory conformity guarantee under the Italian Consumer Code. Mandatory remedies for defective, damaged or non-conforming goods are separate from the right of withdrawal and are not limited by any shorter reporting period that may be suggested to facilitate customer support.
8. Website use and intellectual property
Trademarks, text, images, graphics, software and other content belong to their respective owners and are protected by law. You must not use the website for unlawful, fraudulent or third-party-harming activity, compromise its security, or extract content without authorisation.
9. Third-party services and availability
The store is hosted by Shopify and uses Shopify and other technical providers for checkout, payments, hosting, delivery and communications. Shopify processes information about access to and use of the store to provide, secure and improve those services. Shopify Network Intelligence and the relevant Shopify Enhanced Services are enabled for this store; Shopify therefore also processes data from interactions with this store, other merchants and Shopify for personalisation, analytics and more relevant advertising. Information may be shared with Shopify and other third parties, including service providers, in countries outside the country of residence, subject to applicable safeguards.
For Enhanced Services processing, Shopify acts as an independent data controller (or “business” under applicable US laws), as described in its Consumer Privacy Policy; we remain controller for our own processing. You can use the Shopify Privacy Portal for available choices. For people in the EEA, United Kingdom or Switzerland, advertising based on those interactions is carried out only after the consent required by law has been obtained; that choice can be changed or withdrawn through cookie preferences. Where US privacy law applies, you can opt out of sale, sharing or targeted advertising through our data-sharing opt-out page or by using Global Privacy Control.
Links to third-party services are not an endorsement or guarantee of their content. We may temporarily suspend the website for security or maintenance and will take reasonable measures to reduce disruption.
10. Liability
Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud, gross negligence, personal injury or breach of mandatory consumer rights. To the extent permitted by law, we are not liable for indirect losses that were not foreseeable when the contract was concluded. This clause does not affect mandatory remedies relating to products or delivery.
11. Privacy
Personal-data processing is described in the Privacy Policy. Preferences for non-essential cookies can be managed through the tools available on the website.
12. Governing law, complaints and jurisdiction
Contracts are governed by Italian law without depriving consumers of mandatory protections in the country of their habitual residence. For consumers, the court of their residence or domicile has jurisdiction where required by law. For business customers, subject to mandatory law, the Court of Busto Arsizio has jurisdiction.
Complaints may be sent to info@thatsitbeauty.com. Any alternative dispute-resolution mechanisms required or made available by law remain available.
13. Changes
We may update these terms prospectively by publishing the new date. Changes do not retroactively alter contracts already concluded unless required by law or agreed with the customer.
